Exemption Salary Minimum (2026)

$684.00/week ($35,568/year)

To be exempt from overtime, an employee must satisfy both the salary threshold and the bona fide executive, administrative, or professional duties tests under 29 C.F.R. Part 541. Highly Compensated Employees (HCE) require $107,432/yr, computer professionals may qualify at $27.63/hr, and certain professions (teachers, doctors, lawyers) are exempt from the salary test. State laws may prescribe higher standards.

Determining the Regular Rate of Pay

Overtime is calculated at 1.5× the employee regular rate of pay, not merely their base hourly wage. Under 29 C.F.R. Part 778 and state wage rules, the regular rate must include all remuneration for employment, including:

  • Non-discretionary productivity and attendance bonuses
  • Shift differentials (e.g., night shift, hazard pay)
  • Commissions and piece-rate earnings
  • Fair market value of non-cash compensation

Excludable payments include discretionary holiday gifts, reimbursed business expenses, and premium overtime rates already paid.

Overtime Exemptions & Duties Tests

An employee is not exempt from overtime simply because they are paid a salary. To be lawfully classified as exempt, an employee must satisfy BOTH:

  1. Salary Basis & Threshold Test: Paid a predetermined, non-deductible salary meeting the statutory threshold ($684.00/wk).
  2. Primary Duties Test: Primary job duties must consist of executive (management of enterprise), administrative (exercise of discretion on significant business operations), or professional (advanced knowledge in a specialized field).

Salaried non-exempt workers must be paid overtime for all hours worked over 40 in a workweek.
